Binding Contractual Agreement & Global Scope Notice
By accessing, browsing, registering an account, or submitting genealogical records to this family tree platform ('Platform'), you enter into a legally binding contract governed by the Indian Contract Act, 1872, Information Technology Act, 2000, and applicable international consumer protection laws. These Terms apply universally to all users across India, Gujarat, and global jurisdictions. If you do not agree to these Terms, you must immediately cease accessing the Platform.
Section 1: Binding Contractual Agreement & Acceptance
1.1 Binding Agreement: Accessing or submitting data to the Platform constitutes your explicit agreement to these Terms and Conditions.
1.2 Electronic Signature: Electronic acceptance under IT Act 2000 Section 10A carries full legal weight.
Section 2: User Eligibility, Account Registration & Security
2.1 Age Eligibility: Users registering member or administrator accounts must be at least 18 years of age (or have verified parental/guardian consent).
2.2 Account Security: Users are responsible for maintaining password secrecy and all actions performed under their account.
Section 3: Directory Submissions & Truthfulness Warranty
3.1 Truthfulness Warranty: All submitted names, vital dates, relationship links, and geographic selections (District, Taluka, Village) must represent genuine historical facts.
3.2 Prohibited Submissions: Creating fake, fraudulent, or malicious profiles is strictly prohibited.
Section 4: Intellectual Property & Collaborative Content License
4.1 Platform IP: Software code, database architecture, UI design, and algorithms are the exclusive IP of the Platform.
4.2 Content License: By submitting genealogical data, you grant the Platform a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to host, display, index, translate (EN/GU), and link the data into the shared family tree.
4.3 Lineage Integrity: Integrated historical tree nodes cannot be unilaterally deleted if deletion breaks verified ancestral lines of other family branches.
Section 5: Strict Anti-Scraping Protection & Computer Misuse Warnings
5.1 Anti-Scraping Ban: Using web scrapers, bots, spiders, crawlers, or automated scripts to harvest directory records or member contact details is strictly prohibited.
5.2 Computer Misuse: Unauthorized automated scraping constitutes a criminal offence under Section 66 of the Information Technology Act, 2000 and international computer fraud laws.
Section 6: Geographic Classification & Location Accuracy
6.1 Geographic Taxonomy: Directory records are indexed by Country, State, District, Taluka, and Village for location filtering. Users must assign accurate geographic classifications.
Section 7: Profile Claiming, Verification & Dispute Resolution
7.1 Profile Claiming: Living individuals may claim their profile by passing security challenge verification.
7.2 Profile Locking: Claimed living profiles are locked against unauthorized third-party edits.
Section 8: Administrative Moderation & Super Admin Governance
8.1 Moderation Governance: Super Admins and Admins reserve the right to edit inaccurate records, merge duplicate profiles, and suspend accounts that violate these Terms.
8.2 Audit Logging: Administrative actions are logged in audit_logs.
Section 9: Third-Party Integrations (Google Services)
9.1 Google Terms: Platform usage incorporates Google Analytics and Google Ads services subject to Google's terms.
Section 10: Absolute Disclaimer of Warranties
10.1 AS IS Disclaimer: THE PLATFORM IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND. THE PLATFORM DOES NOT GUARANTEE THAT GENEALOGICAL RECORDS ARE COURT-ADMISSIBLE FOR LEGAL INHERITANCE DISPUTES, LAND TITLE CLAIMS, OR OFFICIAL CITIZENSHIP PROOFS.
Section 11: Limitation of Liability
11.1 Liability Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
Section 12: Indemnification
12.1 User Indemnity: Users agree to defend, indemnify, and hold harmless the Platform, founders, administrators, and developers against claims, damages, or legal fees arising from user submissions or breach of terms.
Section 13: Account Termination & Service Suspension
13.1 Termination Grounds: The Platform reserves the right to suspend or terminate accounts for terms violation or illegal scraping.
Section 14: Governing Law & Exclusive Jurisdiction (Gujarat, India)
14.1 Governing Law: These Terms are governed exclusively by the laws of India and the State of Gujarat.
14.2 Jurisdiction: Any legal disputes shall be subject to the exclusive jurisdiction of competent courts located in Gujarat, India.
Section 15: Miscellaneous Provisions & Severability
15.1 Severability: If any provision is held invalid, remaining provisions remain in full force and effect.
